    Please read these Terms of Service ("Terms") carefully before using the mydvcplanner.com website ("Service") operated by MyDVCPlanner ("us," "we," or "our"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms.

    1. Acceptance of Terms

    By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

    MyDVCPlanner is an independent tool that helps Disney Vacation Club (DVC) members optimize their point usage by searching DVC resort availability and identifying cost-effective booking strategies, including split-stay combinations. The Service includes:

    • Availability search across DVC resorts and room types
    • Point cost comparison and optimization (including split-stay analysis)
    • Availability alert notifications via email
    • Resort guides, tips, and educational content about DVC
    • Saved searches and vacation planning tools

    3. User Accounts

    To access certain features of the Service, you must create an account. When you create an account, you agree to:

    • Provide accurate, current, and complete information during registration
    • Maintain and promptly update your account information
    • Maintain the security of your password and accept all risks of unauthorized access
    • Immediately notify us of any unauthorized use of your account

    You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for unauthorized purposes.

    4. Accuracy of Information

    Important: While we strive to provide accurate and up-to-date DVC availability and point cost information, we cannot guarantee the accuracy, completeness, or timeliness of any information provided through the Service. Our availability data is updated approximately once daily and may not reflect real-time changes.

    You should always verify availability and point costs through the official Disney Vacation Club booking system before making any reservation decisions. MyDVCPlanner is a planning and research tool — it is not a booking platform and cannot make reservations on your behalf.

    5. Intellectual Property

    The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of MyDVCPlanner. The Service is protected by copyright, trademark, and other laws. Our trademarks may not be used in connection with any product or service without our prior written consent.

    Disney Vacation Club, Walt Disney World, Disneyland, and all related names, logos, and brands are trademarks of The Walt Disney Company. Their use on this site is for informational purposes only and does not imply endorsement or affiliation.

    6. Acceptable Use

    You agree not to use the Service to:

    • Violate any applicable local, state, national, or international law or regulation
    • Scrape, crawl, or use automated tools to extract data from the Service beyond normal browser usage
    • Attempt to gain unauthorized access to any portion of the Service, other accounts, or any systems or networks connected to the Service
    • Interfere with or disrupt the Service or servers/networks connected to the Service
    • Use the Service for any commercial purpose without our express written consent
    • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission
    • Transmit any viruses, worms, defects, Trojan horses, or other items of a destructive nature

    By creating an account and setting up availability alerts, you consent to receive email notifications when matching availability is found. You may opt out of these communications at any time through your profile settings or by using the unsubscribe link included in every email.

    We may also send you service-related announcements when it is necessary to do so (e.g., maintenance notifications, security alerts, or changes to these Terms). You may not opt out of service-related communications.

    8. Disclaimer of Warranties

    The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

    We do not warrant that: (a) the Service will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results of using the Service will meet your requirements.

    Specifically, we do not guarantee:

    • The accuracy of DVC point costs displayed on the Service
    • The availability of any specific resort or room type
    • That point costs or availability shown will match what you see on the official DVC booking system
    • That split-stay combinations shown will result in actual point savings when booked

    9. Limitation of Liability

    In no event shall MyDVCPlanner, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

    • Your access to or use of (or inability to access or use) the Service
    • Any conduct or content of any third party on the Service
    • Any content obtained from the Service
    • Unauthorized access, use, or alteration of your transmissions or content
    • Booking decisions made based on information provided by the Service

    10. Indemnification

    You agree to defend, indemnify, and hold harmless MyDVCPlanner and its licensors, employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or your violation of these Terms.

    11. Termination

    We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

    12. Governing Law

    These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

    13. Changes to Terms

    We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
